SECTION 13 - ORDERS AND CONTRACT FORMATION
All orders placed through our website are subject to acceptance and availability.
After placing an order, you may receive an order confirmation email. This email is only an acknowledgement of receipt of your order and does not constitute acceptance of your order.
A contract between you and us is formed only when we dispatch the goods to you.
We reserve the right to reject or cancel any order before dispatch for any lawful reason, including but not limited to stock availability, pricing errors, payment issues, suspected fraud or suspected unauthorised resale activity. If payment has already been taken for a cancelled order, we will refund that payment in full.
SECTION 14 - DELIVERY
We aim to dispatch all orders placed before 3:00pm (Monday to Friday) on the same working day.
Orders placed after 3:00pm on Friday, or on Saturday or Sunday, will be dispatched on the next working day.
All orders are subject to stock availability, security checks and peak period demand.
We offer the following delivery options:
- Standard Delivery (3 Working Days): Free
- Next Working Day Delivery: £4.95
Next working day delivery applies to working days only, Monday to Friday. We do not offer a Saturday delivery service.
Delivery timeframes are estimates only and are not guaranteed.
We use a range of trusted carriers depending on the size, weight and value of the order.
Additional delivery charges may apply for certain locations, including the Scottish Highlands, UK Islands and Northern Ireland. Where applicable, these charges will be communicated before dispatch.
Where your order contains multiple items, we may ship these separately and your order may arrive in multiple deliveries.
You are responsible for ensuring that the delivery address and contact details provided at checkout, including your email address and phone number, are accurate and complete. If an incorrect or incomplete delivery address is provided, we will not be responsible for any loss, delay or misdelivery arising from that error, and we reserve the right to charge any additional costs incurred.
If you instruct the courier to leave the parcel in a safe place, with a neighbour or otherwise in accordance with your delivery instructions, the goods will be treated as delivered once the courier has followed those instructions. Responsibility for the goods passes to you at that point.
If delivery is unsuccessful because the address is incorrect, no one is available to accept delivery, the parcel is not collected from a depot, or the courier is unable to contact you using the details provided, we reserve the right to deduct any additional delivery and return costs from any refund or to charge for re-delivery.
During busy periods, including Black Friday, Christmas and promotional events, dispatch and delivery times may be extended.
SECTION 15 - DELIVERY ISSUES, LOSS AND DELAY
You should inspect your goods promptly upon delivery.
If your order arrives damaged, incomplete or incorrect, you must notify us within 48 hours of delivery and provide your order number together with any requested supporting evidence, including photographs of the item and packaging.
If your order is reported as lost or undelivered, we will investigate with the courier. Courier investigations may take up to 5 working days.
Refunds or replacements will not be issued until the courier investigation has been completed and the parcel has been confirmed as lost.
Nothing in this section affects your statutory rights where goods are faulty, not as described or not delivered.
SECTION 16 - CONSUMER RIGHT TO CANCEL
If you are a consumer and purchase goods online, you generally have the legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days after the day on which you receive the goods. If goods are delivered in multiple consignments, this period runs from the day after you receive the last item.
To exercise your right to cancel, you must notify us of your decision to cancel within that period.
Once you have notified us, you must return the goods within a further 14 days.
You are responsible for taking reasonable care of the goods while they are in your possession. We may make a deduction from any refund for loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
SECTION 17 - EXTENDED CHANGE OF MIND RETURNS
In addition to your legal rights, we offer an extended 30-day change of mind return period from the date of delivery.
To qualify for a change of mind return:
- the item must be unused and not installed;
- the item may be opened for inspection only;
- the item must be returned in fully resaleable condition; and
- all original packaging, accessories, manuals and components must be included.
We may reject a change of mind return, or reduce the refund where legally permitted, if the item shows signs of use, installation, wear or damage, or if packaging, accessories or manuals are missing or damaged.
For vacuum-packed or sealed items, once opened these items cannot be returned for change of mind unless they are faulty or not as described.
SECTION 18 - RETURN AUTHORISATION AND RETURN COSTS
All returns must be authorised by us before being sent back.
To request a return, contact us at:
Email: help@futuradirect.co.uk
Phone: 01302 540326
You must provide your order number, reason for return and any supporting photographs where relevant.
We will not reimburse or cover return costs where an item is sent back without prior authorisation.
Where goods are faulty, damaged, incorrect or not as described, we will arrange or reimburse reasonable return costs as appropriate.
For change of mind returns, the customer is responsible for return shipping costs unless otherwise agreed.
SECTION 19 - FAULTY GOODS, DAMAGED GOODS AND MISSING PARTS
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.
If goods are faulty, not as described or unfit for purpose, you may be entitled to a repair, replacement, price reduction or refund depending on the circumstances and the time elapsed since delivery. Nothing in these Terms affects those rights.
Where a fault is reported, we may require the item to be returned or otherwise inspected before confirming the appropriate remedy.
Any missing parts must be reported within 14 days of delivery. If reported within that timeframe, we will supply the missing part where appropriate. Claims made after that period may be refused.
SECTION 20 - REFUNDS
Refunds will be made to the original payment method only.
Where goods are returned, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, where applicable under law.
Please allow up to 10 working days for an approved refund to reach your account, depending on your payment provider.
SECTION 21 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
To the fullest extent permitted by law, we exclude all warranties, representations and conditions not expressly stated in these Terms.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or for breach of your statutory consumer rights.
Subject to the above, we shall not be liable for any indirect or consequential loss or damage, loss of profit, loss of revenue, loss of business, loss of opportunity or loss of data arising out of your use of the Service or any products purchased through the Service.
SECTION 22 - CHARGEBACK AND DISPUTE PROTECTION
We reserve the right to provide proof of delivery, courier tracking information, delivery confirmation, GPS data and photographic evidence where available in order to investigate or dispute chargebacks and payment disputes.
SECTION 23 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Futura Direct Ltd and our directors, officers, employees, affiliates, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
SECTION 24 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 25 - TERMINATION
These Terms are effective unless and until terminated by either you or us.
You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
SECTION 26 - ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Cookie Policy, Delivery Policy and Returns Policy, constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior agreements, communications and proposals, whether oral or written, between you and us.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 27 - PRIVACY AND COOKIES
Our use of your personal data is governed by our Privacy Policy and Cookie Policy.
We use cookies and similar technologies on our website. Information about how we use cookies, what they do and what choices you have should be explained clearly and made easily available to users.
SECTION 28 - GOVERNING LAW
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
If you are a consumer, you may also have the benefit of any mandatory provisions of the law of the country in which you are resident.
SECTION 29 - CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
